📄 General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions apply to all digital services, consulting, and technical solutions provided under the brand name “Eudemonia Coaching.”

The services are divided into two areas:

• B2C Coaching Modules (Pickaxe GPT Services) → modules such as “Eudemonia Guide,” “Architect,” “Strategist,” “Oracle”

• B2B RAG System Services → e.g., “Accommodation Concierge” and other specialized chat services based on our GDPR-compliant RAG system

2. Services

• B2C Coaching (Pickaxe GPT Modules): digital coaching content, personality assessments, strategic implementation support, AI-based modules via Pickaxe and Systeme.io

• B2B RAG System (e.g., Accommodation Concierge): GDPR-compliant chat and automation services, operated within the EU (Azure, Hetzner, IONOS)

The specific content and formats (modules, subscriptions, one-time access, corporate solutions) may change as part of ongoing development.

3. Contract Conclusion

A contract is concluded once an order has been placed via one of the platforms used (e.g., Systeme.io, Stripe, Pickaxe) and payment has been successfully completed. By booking, the customer agrees to these GTC.

4. Prices and Processing

Service prices are displayed on the respective offer page. Payment processing is handled via Stripe. In the case of subscriptions, the amount is collected monthly in advance.

5. Usage Requirements

• Use of certain tools may require a separate account with third-party providers (e.g., Pickaxe.co, OpenAI, Substack).

• The customer is responsible for access and account management.

6. Technical Infrastructure

• B2C Coaching (Pickaxe GPT): use of external providers (Pickaxe, Systeme.io, Stripe, TidyCal, Substack). Changes to these platforms may affect usage without giving rise to claims.

• B2B RAG System Services: operated exclusively in the EU via Azure (EU region), Hetzner (Germany), and IONOS (Germany).

7. Liability

• No liability is accepted for external platforms (Pickaxe, Stripe, Systeme.io, etc.); usage is at the customer’s own responsibility.

• For RAG System Services, statutory liability applies, excluding intent or gross negligence.

8. Withdrawal / Termination

• For digital products, the right of withdrawal expires once the service has been executed (§ 312g BGB), provided the customer has consented.

• Subscriptions may be canceled at any time at the end of the billing period.

9. Exclusion of Withdrawal & Return

Live online services (e.g., webinars, coaching) as well as digital content (e.g., e-books, software, videos) are excluded from exchange/return once provided (§ 312g para. 2 no. 1 and 2 BGB).

10. Disclaimer for AI-Generated Content

• AI-based content (e.g., GPT) may be erroneous or incomplete.

• They are to be understood as inspiration and do not replace professional advice.

• Review by qualified experts (law, taxes, health) remains necessary.

11. Privacy

The provisions of the separate Privacy Policy apply.

12. Final Provisions

German law applies. Place of jurisdiction is Mainz, where legally permissible. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.

4. Data Processing – B2B RAG System Services (GDPR-Compliant)

Types of data processed:

• Communication data in chats (questions, messages, text)

• Technical metadata (date, time, URL, shortened IP, browser/device)

• E-mail for follow-ups

• Affiliate links (external redirection, subject to third-party privacy policies)

Purposes:

• Responding to user inquiries

• Operation, security, error analysis

• Follow-up e-mails (Substack, opt-in)

• Affiliate/partner recommendations

Legal basis:

• Art. 6 (1) (b) GDPR (contract/initiation)
